Terms & Conditions — Affordable Refrigeration Services Inc.

1. Scope of Services

Affordable Refrigeration Services Inc. provides commercial and industrial refrigeration services throughout Ontario, Canada, including but not limited to:

• Emergency breakdown repair for walk-in coolers, walk-in freezers, display cases, and condensing units.
• Preventive maintenance, inspection, and safety certification programs.
• Installation and commissioning of commercial refrigeration equipment.
• Cold room construction, modification, and retrofitting.
• Ice machine cleaning, repair, and installation.
• Refrigerant leak detection, recovery, and recharge.

If your facility requires specific licensing, certification or insurance documentation, please confirm those requirements with the dispatch team before service is booked.

2. Service Agreements & Quotes

• All quotes are provided in writing following an on-site diagnostic assessment. Verbal estimates are indicative only and not binding.
• Work commences only upon the Customer's written (email, text, or signed document) authorization of the itemized quote.
• Quotes are valid for 14 calendar days from the date of issue, subject to parts availability and market pricing fluctuations.
• If additional issues are discovered during the course of authorized repairs, we will immediately notify you and obtain written authorization before proceeding with additional work.
• Emergency dispatch service calls are subject to a diagnostic service call fee, which will be disclosed prior to dispatch.

3. Payment Terms

• Payment is due upon completion of services unless a credit account has been established in writing in advance.
• We accept major credit cards, electronic funds transfer (EFT), cheque, and e-Transfer.
• Invoices not paid within 30 days of the due date are subject to a late payment charge of 1.5% per month (18% per annum), compounded monthly.
• Accounts outstanding beyond 60 days may be referred to a collection agency, and reasonable collection costs will be added to the outstanding balance.
• Title to all replacement parts remains with Affordable Refrigeration Services Inc. until full payment is received.
• All prices are quoted and invoiced in Canadian Dollars (CAD) and are subject to applicable HST (Harmonized Sales Tax) as required by the Ontario Government.

4. Warranty

• Labour Warranty: Any workmanship warranty will be stated in the written quote or service agreement, including its scope and exclusions.
• Parts Warranty: Any applicable manufacturer warranty will be identified in the quote or service documentation.
• Exclusions: Warranties do not cover damage caused by misuse, neglect, improper operating conditions, unauthorized modifications, power surges, or force majeure events (floods, fire, vandalism).
• Refrigerant Warranty: Refrigerant charges are warranted only if the cause of refrigerant loss was fully remedied during the same service visit. Pre-existing or unrelated leaks are excluded.
• Warranty claims must be reported within the warranty period by contacting us at +1 (647) 515-8643.

5. Limitation of Liability

To the maximum extent permitted by applicable Ontario law:

• Affordable Refrigeration Services Inc. shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of product/inventory, loss of revenue, or business interruption, arising from equipment failure, delay in service delivery, or any act or omission in connection with our services.
• Our total aggregate liability for any claim relating to a specific service engagement shall not exceed the total amount paid by the Customer for that specific service.
• Any insurance documentation requested by a customer can be discussed with the service team before work is booked.

6. Customer Responsibilities

• The Customer must provide safe, unobstructed access to all equipment to be serviced, including adequate lighting and electrical power supply for diagnostic tools.
• The Customer is responsible for emptying, relocating, or protecting perishable inventory as necessary prior to and during service operations.
• The Customer must inform the Company of any known hazards, asbestos, chemical storage, or other environmental concerns in the service area prior to the technician's arrival.
• The Customer must operate equipment in accordance with manufacturer guidelines and applicable Ontario Food Safety and HACCP standards.

7. Cancellation & Rescheduling

• Scheduled service appointments may be cancelled or rescheduled without penalty if notice is provided at least 4 hours before the scheduled appointment time.
• Cancellations made with less than 4 hours' notice may be subject to a cancellation/trip fee equal to the diagnostic service call fee.
• Emergency dispatch cancellations once a technician is en route will be billed the full dispatch and travel fee.

8. Governing Law & Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

• Any dispute arising from these terms or related services shall first be attempted to be resolved through good-faith negotiation.
• Unresolved disputes shall be submitted to the courts of competent jurisdiction in the Province of Ontario.
• Small claims (under $35,000 CAD) may be referred to the Ontario Small Claims Court.

9. Website Use Terms

• All content on this website, including text, images, graphics, and branding, is the intellectual property of Affordable Refrigeration Services Inc. and may not be reproduced without written permission.
• This website is provided "as is" without warranties of any kind, express or implied, including accuracy, completeness, or fitness for a particular purpose.
• We reserve the right to modify, suspend, or discontinue any aspect of this website at any time without notice.
• Automated scraping, crawling beyond standard search engine indexing, or data harvesting from this website is strictly prohibited.

10. Severability & Entire Agreement

If any provision of these Terms & Conditions is found to be invalid or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms & Conditions, together with any written service agreement or quote authorization, constitute the entire agreement between the Customer and Affordable Refrigeration Services Inc. and supersede all prior oral or written communications regarding the subject matter herein.
